Chapter 11 Bankruptcy Estate Donates $730,000 to Charities
Sandra Reese, founder and senior managing director of Reese Partners, announced that over $730,000 in surplus funds from the Xpedior Chapter 11 Bankruptcy Estate was donated to charities. Working closely with co-counsel DLA Piper and Katsky Korins and the Creditors Committee over a five-year period, Ms. Reese's efforts resulted in creditors being repaid 100 percent of their $10,500,000 in allowed claims, as well as more than $2,500,000 in interest relating to the claims. The approved Plan of Liquidation contemplated a 28 percent recovery and resulted in the cancellation and extinguishment of all of the ownership interests of Xpedior and affiliated companies.
"The tremendous result achieved in this case was due to several significant factors supporting the joint execution of the Plan, including the settlement of a class action lawsuit, a recovery from certain of Xpedior's former officers and directors, as well as aggressively pursuing all available recovery and claims mitigation opportunities" said Reese. "These opportunities were made possible by the extraordinary skill and diligence in consolidating, reconciling and organizing information from more than six disparate, non-integrated financial systems and databases. These initial efforts, in part, laid the foundation for the successful outcome of this case."
In the end, the Make-A-Wish Foundation and several legal assistance agencies received over $730,000 to support their programs.
